Terms of Service

ClientMail Pty Ltd · Australia · Updated 23 October 2026

These Terms of Service govern business use of ClientMail Professional Email, operated by ClientMail Pty Ltd. By creating an account or using the software, an authorised business representative agrees to these Terms.

1. Service and eligibility

Professional Email is a software platform for verified domains, authorised SMTP/email API connections, business contacts, templates, transactional communications, queues, available delivery reports and customer responses. Subscriptions and features are subject to the published plan, verified payment, provider authorisation and account status. You must be authorised to act for your business and use any connected domain or email system.

2. Account and infrastructure responsibilities

Provide accurate account details, protect passwords, manage authorised users, keep SMTP credentials secure and notify us promptly about unauthorised access. Email service providers may require separate account approval, app passwords, API keys or security verification. We do not guarantee compatibility with every email provider or with provider-specific OAuth-only authentication.

3. Acceptable email use

Customers must have a lawful reason for every message, keep contact data accurate and respect unsubscribe, opt-out and suppression requests. Do not use ClientMail for phishing, misleading identity, fraud, purchased unsolicited lists, abusive campaigns or evasion of sending restrictions. Promotional emails are subject to applicable consent and unsubscribe requirements; labelling a message "transactional" does not exempt promotional content from the law. Australian users must comply with applicable laws, including the Spam Act 2003 (Cth), and their sending providers' policies.

4. Email delivery and controls

Sending requires an active subscription and authorised provider configuration. Providers set their own limits and can delay, reject or suspend sending. A provider accepting a message does not prove inbox delivery. An authorised user may deliberately launch or resume a permitted batch only after reviewing its recipients and confirming the action. An administrator may pause or restrict activity for security, provider compliance or abuse reasons. In-flight messages cannot always be recalled.

5. Subscription, billing and refunds

Prices and features appear in the Professional Email billing area. Payment-reference submissions are manually reviewed; entering a transaction identifier alone does not activate a subscription. Verify the network and destination before any cryptocurrency transfer. Renewals, cancellations and refunds depend on the agreed offer and applicable law. Nothing in these Terms excludes or limits non-excludable consumer rights under Australian Consumer Law.

6. Customer data and confidentiality

Customers retain rights to their own lawful business records and original content. They permit ClientMail to process information needed to operate requested features, maintain security, address support matters and comply with law. Our Privacy Policy explains data handling, overseas processing, retention and requests for access or deletion.

7. Service availability and limitations

We may change or interrupt software for maintenance, security, third-party provider changes or legal compliance. Features are available only when genuinely enabled for the customer's account and connected provider. Marketing send dispatch is not included unless separately implemented, authorised and made available in the applicable offer; design and draft tools alone do not authorise marketing delivery.

8. Intellectual property and liability

ClientMail software and branding belong to their respective owners. Customers retain rights to lawful content they supply. To the extent permitted by law, liability limitations in an applicable commercial agreement apply, but nothing excludes non-excludable statutory guarantees or remedies. These Terms are governed by applicable Australian law.

9. Contact and changes

Contact support@clientmail.site or our public enquiry page about billing, cancellation, security or legal questions. Material changes will be communicated when required by the relevant agreement or law.
